Juridiska och historiska fakta som borde beaktas vid FN omröstinngen om Palestina (del 2)

1967 års gränser
Beteckningen 1967 års gränser är juridiskt inkorrekt. Det har aldrig existerat någon gräns utmed det som också kallas "den gröna linjen".Den gröna linjen var den linje som skillde åt de stridande parterna vid vapenstilleståndsavtalet från 1949 mellan Israel och arabländerna.
När man använder beteckningen "1967 års gräns" ger man felaktigt det intrycket att Israel (när det gäller västbanken) skulle ha erövrat något annat lands territorium, vilket Israel alltså inte har gjort.
I vapenstilleståndsavtalet från 1949 sägs det klart och tydligt att stilleståndslinjen inte är någon gräns och att linjen inte skall påverka var framtida gränser dras.
The exact language of the Israel-Jordan Armistice Agreement, signed on April 13, 1949 and typifying all the respective agreements, reads:
"The basic purpose of the Armistice Demarcation Lines is to delineate the lines beyond which the armed forces of the respective Parties shall not move. … [as] agreed upon by the Parties without prejudice to future territorial settlements or boundary lines or to claims of either Party relating thereto."


Det är värt att notera att även den ofta citerade resolution 242 från FN:s säkerhetsråd inte kräver att Israel skall dra sig tillbaka från alla de områden som erövrades under kriget 1967, inte heller fastslår resolutionen någon gränslinje, utan säger bara att alla stater i området har rätt till säkra och trygga gränser.

Några uttalanden från personer som var med och skrev resolution 242:
The U.S. ambassador to the UN at the time, former Supreme Court Justice Arthur Goldberg, pointed out in 1973 that the fact that the resolution omitted to call for total withdrawal is in recognition of the fact that "Israel‟s prior frontiers had proven to be notably insecure." 

Even the Soviet delegate to the UN, Vasily Kuznetsov, who fought against the final text, conceded that the resolution gave Israel the right to "withdraw its forces only to those lines it considers appropriate."

Lord Caradon, the British UN Ambassador at the time and the resolution‟s principal drafter, who introduced it to the Council, said in 1974 unequivocally that:
"It would have been wrong to demand that Israel return to its positions of June 4, 1967, because those positions were undesirable and artificial."

Eugene V. Rostow, U.S. Undersecretary of State for Political Affairs in 1967 and one of the drafters of the Resolution, stated in 1990 that it and subsequent Security Council Resolution 338:
"...rest on two principles, Israel may administer the territory until its Arab neighbors make peace; and when peace is made, Israel should withdraw to „secure and recognized borders,‟ which need not be the same as the Armistice Demarcation Lines of 1949. "

Även den så kallade "Vägkartan" som presenterades av Kvartetten (USA, Ryssland, EU,FN)  2003 hänvisar till "behovet att ännu förhandla om permanenta gränser".

Omstritt territorium
Oftast beskrivs västbanken som ockuperat område (belligerent occupation) i stället för omstritt område vilket har  en stor psykologisk effekt på omvärlden.
När man väljer att kalla området för ockuperat i stället för omstritt ignorerar man helt gällande internationella avtal som ger judarnana rätt att där  återupprätta sin nationalstat. (stadgarna för Palestina mandatet och beslut från San Remo konferenssen), samt det faktum att de områden som Israel erövrade 1967 inte tillhörde någon annan stat.
Eftersom inga gränser har fastslagits men området enligt bindande avtal tillhör judarna borde man ifall man vill använda ordet ockupationen  tala om israeliskt/judiskt ockuperat territorium inte ockuperat palestinskt territorium.

It could be argued that Israel‟s "occupation" of the disputed territories does not fall under the classic definition of military or "belligerent" occupation, in that such "occupation occurs when a belligerent state invades the territory of another state with the intention of holding the territory at least temporarily." The territory that Israel reclaimed in 1967 was never rightfully "the territory of another state", nor did Israel obtain it by war of aggression. Indeed, it was territory that had been specifically designated for a Jewish national home, under the legally binding Mandate for Palestine in 1922. Despite the eastern three quarters of the territory then known as "Palestine" being partitioned off from the originally mandated Jewish national home to form the Arab state of Trans-Jordan, nothing has altered the Mandate west of the Jordan or assigned that territory to a state other than Israel.
